Artist Terms and Conditions (updated February 2023)

Background

a) Celtic Casting Ltd (CC) is an employment agency that finds opportunities for our members to work primarily in the film, TV and advertising industries, directly with hirers (including but not limited to production companies) and through our clients (including but not limited to casting agents and casting directors).

b) All clients and hirers who work with CC enter into a contract with us prior to having access to our database of artists. CC will share your relevant personal information with its verified clients and hirers to find you work.

c) Where a job is introduced by one of our clients, CC will always collect payments on your behalf directly from the hirer to ensure you are paid promptly and efficiently through our payment process.

Authority

d) This Agreement is a legal Agreement between you (the “Member”) and CC. By subscribing to the services provided by CC you agree to the following Terms and Conditions.

e) By accepting these Terms and Conditions you hereby grant CC authority to enter into a contract with a hirer on your behalf.

Right to Work

f) You hereby undertake that you have the right in law to accept and undertake work in Ireland by virtue of your citizenship or immigration status. You must inform CC immediately if there is a change in your legal right to work.

Photographs

g) You are able to upload your own photos through our website for casting purposes. By uploading user photos to our system you grant us a worldwide non-exclusive licence to use such photos in any media for the purpose of finding you work until such photos are deleted from our system. You further indemnify us against any third party claims brought against us in respect of your user photos. Please note that where user photos are not your original work you need the permission of the copyright holder for our use of the photos under this paragraph. Photos of poor quality, copyrighted photos, or photos which are deemed offensive may be removed. CC reserves the right, to reject or remove any photographs that do not comply or where we judge the photo not to be of a good standard. You agree that at all times the photograph on your members account is an up to date representation of how you currently look. For members under 12 years of age, the parent or legal guardian agree to update the photos every 6 months.

h) In the course of registering you as an artist with CC, and at other times, we may commission our own photographs of you (“casting photos”). You hereby grant your consent to the use of your likeness in the casting photos in any media worldwide in perpetuity for the purpose of finding you work, and for the promotion of CC. Please note that you will have no right to use our casting photos for any purpose.

Working for Us

i) You are expected to behave in a professional manner at all times, both in your dealings with CC, with our clients, hirers and on set. This includes responding promptly to availability enquiries and check-in requests sent via CC, being reliable, polite and helpful on set including following directions in a timely manner and bringing the appropriate dress as directed. Failure to act in a professional manner, including lateness or not showing up, will result in termination of your membership at CC’s absolute discretion.

j) If CC obtains any complaints in relation to the work of the Member whether arising out of failure to turn up, punctuality, conduct or otherwise CC shall be entitled to decide to remove the Member from the Database and CC ‘s decision shall be final. No refund of any fees paid will be made in that event.

k) When you are booked for a day of work, you must keep the entire day free as shoots may start early and finish late.

l) Rates of pay and relevant union agreements for any job will be stated on the availability check sent to you. This is your opportunity to decline the offer of work if you do not accept the terms. After you have been penciled or booked for a job, you cannot be released solely on the basis of the rate of pay.

Commission / Rates

m) CC is entitled to charge you a commission for each job successfully placed through CC, which is deducted from each payment to you. The standard rate of commission is between 12% and 20%, but a different rate of commission may apply for certain jobs at CC’s discretion. If a different rate applies, you will be advised of it before being booked to work.

The fee is €70 for a one year adult membership. There is no joining fee. The fee will be deducted with your permission from a PAID SHOOT DATE. You will be notified in your AV check if this is happening. Membership fees will not be deducted without your permission. The fee is only deducted once per 12 month term. There are no membership fees for minors under 18.

n) CC reserves the right to increase or decrease the fees at any time. These price changes will be reflected on our website. Such price changes are immediately effective once they have been published on our website.

Payment

o) You hereby grant CC the exclusive authority to receive money on your behalf for all work booked through us. CC will invoice hirers weekly and aims for all payments to be received within 4 to 12 weeks of the relevant day of work. We are not able to provide individual updates on payments until 8 weeks have passed since the day you worked. In certain jobs, payment will be made directly with production, in such cases you will be notified before the job commences.

p) CC operates a weekly payroll process for any cleared funds, which are paid directly into your bank account by electronic bank transfer. Due to the timings of when funds are received and the weekly payroll, it may on some occasions take more than 10 days for a payment to reach you. It is your responsibility to ensure that we hold your correct bank account details via our online system, otherwise payments will be delayed until such time that we do.

q) CC will provide you with a remittance advice through our online system for each payment made to you, which states your total earnings and details any deductions made for taxes and for commission and administration fees.

Health and Safety

r) In accordance with the Health & Safety in the Workplace Act 2005, the health and safety obligations in the workplace is the sole responsibility of the third party that engages you (generally, but not limited to, the Production Company). You agree to hold harmless and promise not to take legal action against CC and its/their respective directors, employees, and all other persons duly authorised by them, from and against all actions, claims, costs, expenses, damages, liabilities and demands arising directly in connection with any work obtained either directly or indirectly through CC.

s) CC can accept no liability whatsoever for any injury or harm sustained or caused to you, or any financial loss sustained, whilst travelling to or from or whilst engaged in any work introduced to you by CC.

t) It is the hirer’s responsibility as your employer to ensure that you have a safe place of work and that you are properly informed of any relevant health and safety issues. You must however take appropriate care of your own health and safety and co- operate fully with the hirer in their implementation of a safe place of work.

All unsafe practices by a hirer should be reported to us, so that we can take action where appropriate to protect our artists.

Personal Information

CC processes your personal information in accordance with the Data Protection Act 2018 (https://www.dataprotection.ie/en/dpc-guidance/law/data-protection-legislation).

u) CC maintains a secure database of all of our artists’ personal information. We share relevant information (including your user photos, contact details and casting information) with our clients and hirers to secure work opportunities for you. When you are confirmed for work through CC, we will share compliance information on a need basis with the hirer.

 Access to your sensitive personal information is restricted on a strict need to use basis. Bank account details are never shared outside CC.

Your details will remain on the celticcasting.ie database until you contact us directly via email with a request to remove your details.

Minors

v) Under 18’s require a Parental Consent Form to be submitted prior to being considered for opportunities on set. If you are the parent or legal guardian of a Minor (under 18 years of age) who is a member, you give CC the right to enter into legally binding agreements on behalf of the Minor. You further give CC the right to assign this right to a Chaperone who is appointed by CC or a crew member on set.

w) You agree that CC may use this right to sign any documents in relation to the production without seeking your consent prior to or subsequent to signing the documents.

Termination of Membership

x) You may terminate your membership with CC in writing only after the completion of, or release from, any remaining days of work that you have been booked or penciled for. CC may terminate your registration at any time by giving you two weeks notice. CC reserves the right to terminate your registration with immediate effect for any serious breach of these Terms and Conditions. For the purpose of this paragraph, any material breach which has not been remedied within a reasonable time shall be considered a serious breach. CC will give notice of termination under this section and its basis in writing.

Liability

y) This Agreement constitutes the entire understanding and Agreement between the Member and CC with respect to the subject matter hereof. If any provision of this Agreement shall be held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be in any way affected or impaired thereby. CC shall not be liable for any delay or failure in performance under this Agreement or interruption of service resulting from acts of God, civil or military authority, war, labour disputes, materials provided by third parties, or any cause beyond the reasonable control of CC.

Use of CC services is at the Member’s own risk. CC makes no warranty that the services will meet Member’s requirements, or that the services will be uninterrupted, timely, secure, or error free; nor does CC make any warranty as to the results that may be obtained from the use of the services or as to the accuracy or reliability of any information obtained through the services or that defects in the services will be corrected.

Variations

z) CC reserves the right to amend these Terms and Conditions at any time and at its sole discretion and without notice to the Member. Any such revision will be binding and effective immediately on posting of notification of such changes on the web page. If you do not accept the varied Terms and Conditions, you must give notice to us in writing before the varied Terms and Conditions take effect. In this instance, your membership with CC will be terminated immediately following the completion of, or release from, any remaining days of work booked or penciled on the date of notice.

This Site and related Services are provided by Celtic Casting Ltd. By using Celtic Casting’s Site and Services, you agree to the terms and conditions below.

Under the General Data Protection Regulation (EU) 2016/679, We Got POP Ltd acts as a data controller for Celtic Casting.

Information We Collect From You

Our service is designed to capture personal details in order that third parties wishing to recruit extras may recruit you. Therefore, registration and subscribing to our service requires you to give us contact information (such as your name and contact number). This information is used to contact you about the services Celtic Casting provides. All other information is optional, but it is advisable to provide as much information as possible so that we can provide a better service to users of our service.  Your contact information may be used to send you additional information and promotional material.

Please note that you should never include any personal data on your profile that you would wish to remain private.

Information Submitted By You

We will use information supplied by you (including, without limitation, sensitive personal data) to aid the promotion, reviewing and hiring of Artists and associated administrative functions made through this Site. This involves us among other things, processing and storing information (including, without limitation, sensitive personal data) and passing or making available online such information to production crew, companies or third parties assisting them in the booking process. We may use third parties to help process your information as part of the intention of booking you in work. We may collect and aggregate information with selected third parties. You consent to us using information provided by you (including, without limitation, sensitive personal data) in each of these ways.

We will process any data which you provide in completing online registration or application forms and any further forms, assessments or personal details, which you complete or provide to us when using the Site in accordance with Irish data protection legislation.

If you have provided us with personal information, it is your responsibility to ensure that it is correct and up to date. This will enable us to provide you with the best service. Please contact us as soon as possible if you believe that any information we are holding on you is incorrect or incomplete.

How We Use Your Personal Data

We use your personal data in the following ways:

  1. to deliver the service effectively to you and to help resolve issues you may experience with the service;
  2. to ensure that the Service and its content is presented in the most effective manner for you and for your mobile device or computer;
  3. to analyse the ways in which you use the Service to ensure you get the best experience;
  4. to carry out our obligations arising from any contracts entered into between you and us;
  5. to allow you to participate in interactive features of our service, when you choose to do so;
  6. to notify you about changes to our service;
  7. to provide you with information, products or services that you request from us or which we feel may interest you, where you have consented to be contacted for such purposes;
  8. to enforce our Terms of Service and other legal rights; and to comply with applicable legal requirements, industry standards and our policies.
  9. Celtic Casting maintains a database of personal data for all User profiles created on Celtic Casting. For Users looking to be introduced to work via Celtic Casting, the following shall apply:
    1. Celtic Casting shares relevant information (including user photos, contact details and worker information) with hirers and production companies.
    2. When a User is confirmed on an engagement, Celtic Casting will share compliance information on a need basis with the Hirer.
    3. On termination of a User’s registration with Celtic Casting, we will keep the User’s contact and compliance information for as long as required by law.

How We Hold and Protect Your Personal Data

Celtic Casting Ltd has an agreement with We Got POP Ltd to provide Celtic Casting Ltd. software for booking and managing our artist profiles. The data controller, POP, is a trading style of We Got POP Ltd., The Print House, 18 Ashwin Street, London E8 3DL registered at the UK Information Commissioner’s Office (Reg. No. ZA014968 ). POP is the data storer but ultimately the information is owned by Celtic Casting Ltd. Celtic Casting Ltd authorises relevant employee’s within POP to view data for the purpose of enabling Celtic Casting to book artists.

We Got POP Ltd acts as a data controller for Celtic Casting.

We take a number of steps to protect your information from unauthorised access, use or alteration and unlawful destruction, including where appropriate:

  1. Limiting access to the information we collect about you (for instance, only those of our employees who need your information to carry out our business activities are allowed access).
  2. Putting in place physical, electronic, and procedural safeguards in line with industry standards including ISO27001:2013.

All personal data collected will be processed for no longer than necessary to achieve the purposes for which it was collected and processed initially, unless otherwise required or authorised by applicable law.

Data Protection

Celtic Casting LTD regards the lawful and correct treatment of your personal information by us as very important to our business. To this end we fully endorse and adhere to data protection law in Ireland and General Data Protection Regulations.

If you are working via Celtic Casting by a hirer or by a third-party, please note that your hirer or third-party may also act as your Data Controller, and additionally for any third party tools that your hirer or third-party may employ to administer your data. It is your responsibility to ensure that your hirer or third-party only processes your personal data in accordance with your wishes. We do not give out your personal bank information to any hirer unless we have your consent.

Cookies

Our site may use cookies to secure your interaction while you are on the site. A cookie is a piece of data stored on the user’s hard drive which may be requested by our site. We may use cookies to deliver content specific to your interests and to save your personal preferences, so you do not have to re-enter them each time you connect to our website – our cookies are not available to other websites.
